Acceptance of Terms

By accessing or using the Talent Shapers School website (the "Website"), submitting an enrolment application, or utilising any service offered by the School, you ("User", "you", or "your") confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms") in their entirety.

If you are accessing this Website or services on behalf of a minor, you represent that you are the minor's parent or legal guardian and that you accept these Terms on behalf of both yourself and the minor.

If you do not agree with any part of these Terms, you must immediately discontinue use of the Website and our services.

These Terms are to be read alongside our Privacy & Child Safeguarding Policy, which forms part of the legal framework governing your engagement with Talent Shapers School.

About the School

Talent Shapers School is a private educational institution registered and operating in the Republic of Kenya, located at Mwendantu Road, Opposite YWCA, Meru Town, Meru County.

The School offers Kindergarten (Early Years), CBC Primary School, and Junior Secondary School programmes in accordance with the Kenya Institute of Curriculum Development (KICD) curriculum frameworks and under the authority of the Ministry of Education, Kenya.

References to "the School," "we," "us," or "our" throughout these Terms refer to Talent Shapers School and its authorised representatives.

Section 03

Website Use & Acceptable Use Policy

The Talent Shapers School Website is provided for informational and service purposes only. You agree to use the Website only for lawful purposes and in a manner consistent with these Terms.

Permitted Uses

• Browsing school information, programmes, news, and events
• Submitting genuine enquiries or enrolment applications
• Accessing publicly available resources provided by the School
• Subscribing to our newsletter for school updates

Prohibited Uses

You must not use our Website to:

• Submit false, fraudulent, or misleading information in any form or enquiry
• Reproduce, republish, or distribute any Website content without prior written permission from the School
• Attempt to gain unauthorised access to any part of the Website, school systems, or data
• Upload or transmit viruses, malware, or any code that may interfere with Website functionality
• Engage in any activity that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable

Intellectual Property

All content on the Talent Shapers School Website — including but not limited to text, graphics, logos, photographs, videos, icons, data compilations, and the overall design and layout — is the intellectual property of Talent Shapers School or its licensors and is protected under Kenyan copyright law and applicable international intellectual property conventions.

What You May Do

• Print or download a single copy of any page for your personal, non-commercial reference
• Share links to our Website pages on social media for non-commercial informational purposes

What You Must Not Do

• Reproduce any portion of our Website content commercially without prior written authorisation
• Remove or alter any copyright, trademark, or proprietary notices from our content
• Use the Talent Shapers School name, logo, crest, or branding in any way that could imply endorsement, affiliation, or partnership without our written consent
• Create derivative works based on our Website content without permission

Section 05

Enrolment, Admission & School Contracts

Submission of an enrolment application or expression of interest through our Website or directly to the School does not constitute a binding offer of a place at Talent Shapers School. An offer of placement is only made upon written confirmation from the School's Admissions Office following the completion of our admissions process.

Enrolment Agreement

Upon acceptance of a place at the School, parents and guardians are required to sign an Enrolment Agreement, which governs the contractual relationship between the School and the learner's family. The Enrolment Agreement includes, but is not limited to:

• The School's fee schedule and payment terms for the academic year
• The School's Code of Conduct and behavioural expectations for learners
• The School's disciplinary procedures and grounds for suspension or expulsion
• Notice requirements for withdrawal from the School
• Consent for photographs and media use (see Privacy Policy, Section 08)

Accuracy of Application Information

All information submitted in an enrolment application must be accurate, complete, and truthful. The School reserves the right to withdraw an offer of placement or terminate enrolment if it discovers that materially false or misleading information was provided during the admissions process.

Section 06

School Fees, Payments & Financial Obligations

Fee Structure

School fees are set by the School's management at the beginning of each academic year and communicated to enrolled families via the official fee schedule. Fee structures are subject to annual review and may be adjusted with reasonable prior notice.

Payment Terms

• School fees are due and payable at the commencement of each term, unless a written payment plan has been agreed with the School's Finance Office
• The School reserves the right to withhold academic reports, testimonials, or certificates where fees are outstanding
• The School reserves the right to request that a learner not attend school until outstanding fees are addressed, in line with the Enrolment Agreement

Refund Policy

• Fees paid are generally non-refundable once the term has commenced
• Where a learner withdraws before the commencement of a term, a pro-rated refund may be considered at the discretion of School management
• Any special fee arrangements or scholarship agreements are governed by the terms of those specific agreements

Fee Disputes

Any disputes regarding fees or payments should be raised in writing with the School's Finance Office within 14 days of receiving the relevant statement. The School is committed to resolving fee disputes fairly and transparently.

Section 07

Code of Conduct & School Rules

All learners, parents, guardians, visitors, and staff are expected to conduct themselves in a manner that upholds the values, reputation, and safe environment of Talent Shapers School. Our core values are:

• Respect — for all individuals, regardless of background, ability, or belief
• Integrity — honesty and ethical conduct in all matters
• Excellence — a commitment to high standards in learning and character
• Community — contributing positively to the school and wider society
• Safety — maintaining a safe and nurturing environment for every learner

Learner Conduct

Detailed rules and expectations for learners are set out in the School's Student Handbook, provided to all enrolled families. Key expectations include punctuality, wearing the correct uniform, respectful conduct toward staff and peers, and commitment to academic responsibilities.

Parent & Guardian Conduct

Parents and guardians are expected to treat all school staff and community members with courtesy and respect. The School will not tolerate threatening, abusive, or aggressive behaviour toward staff, learners, or other parents — whether in person, by phone, email, or on social media. Such conduct may result in restricted access to school premises or, in serious cases, reporting to law enforcement authorities.

Visitors to Campus

All visitors are required to report to the school reception upon arrival, present identification, and state the purpose of their visit. The School reserves the right to refuse entry to any individual.

Section 08

Social Media Policy

Talent Shapers School maintains official social media pages for the purpose of sharing school news, events, and achievements. These pages are moderated by the School.

When Engaging with Our Pages

• Comments and posts must be respectful, constructive, and relevant
• The School reserves the right to delete comments or posts that are offensive, defamatory, or otherwise inappropriate
• Do not share personal or confidential information about learners, staff, or other community members on public social media platforms

Parents & Community Members

• Do not publish photographs from school events that include other people's children without the consent of those children's parents or guardians
• Do not make defamatory, false, or misleading statements about the School, its staff, or learners on social media. Such conduct may give rise to legal action under Kenyan defamation law.
• Complaints or concerns about the School should be directed to the School's formal channels (see contact details below), not aired publicly on social media

Liability & Disclaimers

Website Accuracy

While we take reasonable care to ensure that the information on our Website is accurate and up to date, Talent Shapers School makes no warranty — express or implied — as to the completeness, accuracy, or fitness for any particular purpose of the Website's content. Content may be updated or changed at any time without notice.

Website Availability

We do not guarantee that the Website will be available at all times, free from errors, or uninterrupted. We reserve the right to suspend or withdraw access to the Website for maintenance, technical reasons, or other operational requirements without prior notice.

Limitation of Liability

We also use certain third-party service providers (such as website analytics tools) to help operate our Website. These providers process data in accordance with our Privacy Policy.

Termination of Access

The School reserves the right, at its sole discretion, to terminate or suspend your access to the Website, any online portal, or school services:

• If you breach any of these Terms of Use
• If you engage in conduct that is harmful, illegal, or contrary to the School's values
• If your enrolment at the School is terminated for any reason set out in the Enrolment Agreement

Termination of access does not affect any legal rights or obligations that have already arisen between you and the School.

Governing Law & Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Kenya.

Complaints & Grievance Procedure

The School is committed to addressing complaints fairly and promptly. Our complaints procedure is as follows:

• Step 1 — Informal Resolution: Raise the concern directly with the relevant class teacher or member of staff
• Step 2 — Head of School: If unresolved, submit a written complaint to the Head of School's office within 14 days
• Step 3 — Governing Board: If still unresolved, escalate to the School Governing Board in writing
• Step 4 — External Resolution: For matters involving regulatory violations, you may report to the Ministry of Education or relevant statutory body

Amendments to These Terms

Talent Shapers School reserves the right to amend, update, or replace these Terms of Use at any time. When changes are made:

• The updated Terms will be published on this page with a revised effective date
• For material changes, we will notify enrolled families through our standard communication channels
• Continued use of the Website or the School's services following notification of changes constitutes acceptance of the revised Terms
